24-May-2023 (In Property Law)
I am ritu. I co-owned a flat in coop society with my father. I was the joint member. After my father's death in 2017 the society has given me the share certificate with my name. I have 1 brother. Initially my father willed this flat to me in his registered will. But just before his death under pressure from my brother he wrote another registered will and willed this flat to my brother. i have only 1 brother now i think i am the owner of this flat. i want to be 100% sure. do i need any more documents to prove ownership?

Hello Neetu I have seen your query related to the well first of all don't admit anything that you have knowledge about any will to be executed by your father secondly even if your brother is having a whale hair and get relief only when you get a letter of succession or what will call probate You have not describe whether you are into the position of the property or not

If the title documents of the property holds your name fully then your brother would not be able to get the share easily. Also Will has be to proven before the court of law before getting any right over the property. However to give any valid answer documents need to be perused. Please feel free to contact Thanks

In order to get his share, firstly your brother needs to prove the registered will in-front of the court of law and get a legal heir certificate. As you mentioned that you are the co-owner of the flat as well, in that case it won’t be easy for your brother to take his share from the said property. In order to give you any further reasonable advice, I will have to pursue with the documents. Please feel free to contact for the same. Thank you.
