Does New sale deeds will be cancelled if old doc comes in existence ?

03-Feb-2023 (In Property Law)
hi, I had purchased property in 1998 on the bases of 1951 and 1967 Urdu document stating about 1 the owner and 2 for owner adopting a child in 1967. Now the owner dies in 1975 registering a will favoring to transfer property to her brother in law. This document is now presented in court after 40 years we purchased from adopted child. We were unaware about all this and we sold it in 2015. So does it affect to us and New owner?

In case a civil suit for title and declaration is filed in court by the brother in law or his dependents, the current owner will be made a party and you might also be made a party. In such a case you will have to file a written statement in court saying how the property was purchased by you and then sold to the current owner. Untill then you need not worry. You had received the property through proper chain of documents.

Certainly it will affect, but there is a procedure for ascertaining whether the will has been mutated or not and for this purpose claimant have to file a suit for declaration of the making you a party well you should consult with your local advocate.....

Sir, this is with reference to the legal query sought. I need to know whether the said so called overnight registered will is probated or not? I need to go through the contents of all the documents first before coming to any conclusion. I have done a similar matter so my legal opinion depends and differ upon the facts and circumstances of each individual case. Regards, Aakriti Jain
