Questions Answered by Advocate Aakriti Jain
Q: Does New sale deeds will be cancelled if old doc comes in existence ?
hi, I had purchased property in 1998 on the bases of 1951 and 1967 Urdu document stating about 1 the owner and 2 for owner adopting a child in 1967. Now the owner dies in 1975 registering a will favoring to transfer property to her brother in law. This document is now presented in court after 40 years we purchased from adopted child. We were unaware about all this and we sold it in 2015. So does it affect to us and New owner?
Advocate Aakriti Jain answered
Sir, this is with reference to the legal query sought. I need to know whether the said so called overnight registered will is probated or not? I need to go through the contents of all the documents first before coming to any conclusion. I have done a similar matter so my legal opinion depends and differ upon the facts and circumstances of each individual case. Regards, Aakriti Jain

Q: Can 17.5 years accused person be treated as major ?
My mother was murdered by a domestic help at Dwarka, Delhi on 15 July, 2016. The servant is 17.5 years old. The JJB has decided to treat him as a child and not as an adult based on a physiologist's recommendation. The servant has pleaded guilty. FIR states that he used a knife and stabbed 30 times. Committed a robbery, hided the knife, cleaned the crime scene, called my father and fabricated a story that outsiders came and committed this crime. I want to know how can I contest the judgement of JJB taken on 18 Jan to treat him as a child. The JJB will take final decision for punishment on 7 Feb. Can we argue to treat him as an adult due the the nature of crime (heinous) & his age 17.5 years and is it worth challenging this in sessions / high court? Appreciate a fast response. Regards,
Advocate Aakriti Jain answered
Sir this is with reference to the legal query sought. The servant/accused will be treated as a minor. Even if the murderer is 17.12 years old and there is a difference of just one day to attain majority, he will be counted in the category of a minor. Please kindly refer mahadev judgment. There are ample number of judgments. Regards Aakriti Jain
Q: What to do in case of unfair practices being used by school
A leading Delhi school kept my child (Age 6) under reprimand for about 2 hours on the pretext of "caught cheating” during test. I was called to school immediately where the principal and headmistress junior school shouted at the top of their voices for about 30 minutes. My child was crying and extremely traumatized. At the time of child’s admission it was clarified to principal, headmistress and class teacher at several occasions that my child comes from a school where there were no tests and exams and hence may need time to settle down in new environment. It has been only 50 days she has attended this school. The school website says they have a counselor on roll but her services were not used to counsel the child. Now as further punishment they have excluded her from school trip and sports day which is so unfair resulting in mental torture. Any form of corporal punishment is banned by NCPCR and RTE act 2009. What legal choices do I have to act against the school at the earliest?
Advocate Aakriti Jain answered
Sir. This is with reference to the legal query sought. The misconduct of the school authorities is uncalled for and I opine you that you should immediately lodge a criminal complaint with police and thereafter file a criminal case against the school. I would further advise that in order to have a stringent and a deterrent affect on school, forward the representation to NCPCR and other concerned authorities. Regards, AAKRITI JAIN
