05-Jan-2025 (In Property Law)
I am planning to buy a builder floor in Uttam Nagar , Delhi. What documents I need to check for the complete title like Land records , Registry, etc. Please guide me on the problem .
When buying a builder floor in Uttam Nagar, Delhi, it is crucial to conduct thorough due diligence to ensure a clear and marketable title. Verify the original title deed, chain of ownership, and mutation or land records to confirm the seller's ownership and ensure the property is free from disputes. Check the approved building plan, completion certificate (CC), and occupancy certificate (OC) to confirm compliance with legal and construction norms. Obtain an encumbrance certificate (EC) to ensure there are no pending loans or liabilities, and verify property tax receipts to confirm taxes are paid. Additionally, check for NOCs from relevant authorities, such as fire, water, and electricity departments, and review the builder-buyer agreement for terms on possession and payments. If the seller is acting on someone else's behalf, validate the registered Power of Attorney, and if the property is within a society, ensure RWA approval. Lastly, confirm that all utility bills and maintenance dues are cleared.
