Do I need a succession certificate or letter of administration?
08-Jul-2023 (In Property Law)
Hello Sir,
My father had left behind a house, land & bank account without nomination. He had not created any will. I'm Hindu & have two brothers and we all want our mother to be legal heir of all the property my father had. I would like to know if it's possible to make single legal heir ?
Also do I need to apply for Succession Certificate (SC) or Letter of Administration (LOA) or Legal heir certificate ? I couldn't get difference between these documents and different lawyers suggesting different procedures. Bank is asking for SC. I'm little confused what legal document should we apply for and what's the court fees involved in each of these documents ? Thanks in Advance !
yes you have to apply for succession certfiicate or legal heriship certificate in the court and all of you have to put up your mothers name for the same and accordingly everyone has to give their noc and rheir statements before the court only then the ne of your mother will be included in the property
Hello there!
Court grants succession certificate in respect of movable property whereas heirship certificate in respect of immovable property. This is mandatory procedure which you have to follow.
Single person can be owner of the property. while filing application for heirship certificate others have to give their no objection for transferring property in the name of that single person.
Court fee is depend on the valuation of property.
