Demolition of property due to bad condition by one of the legal heir

29-Jun-2023 (In Property Law)
We have a joint property in Central West Delhi. There were 3 co-owners (My father & his 2 elder brothers) of this property. They all are died. Now the property is using by me and my cousin brothers. I am the only son of my father. The aforesaid dilapidated property is in an irreparable condition now and has started falling The roof has already partly fallen. Because of its precarious condition, it may fall any time now and lead to loss of life and property of occupants. The whole property, at present, is occupied by the tenants who have been requested several times to vacate the property so that it may be demolished and risk may be mitigated, but the tenants have flatly refused to vacate. We informed MCD about this situation & MCD officials are ready to demolish this building but my cousin brothers are not agreed to demolish this building. They are getting rent of more than 80 thousand from this building. I want to demolish the building to loss of life of anybody. What to do?

Dear Sir,
Given the present facts, you should immediately send a legal notice to the tenants to vacate the building.
Thereafter file a suit in which MCD should be a party to book and demolish the property.

Serve a legal notice to your cousins and tenants asking them to vacate and also to mcd being hazordous property if they do not then file suit against them and court will ask mcd to issue notice to owners and occupants for eviction and then court will direct you or mcd to demolish for being reconstructed. Even mcd can do the needful with police aid.
