Deficiency of service case against builder after taking possession

Dear Sir, Can we file a case against builder on deficiency of service even after 06 years of possession of flat due to unfulfilled promise of providing amenities as promised and construction of additional houses in open area.Poor quality of materials used in the interiors. The flat was vacant for 06 years.Also can one refuse to pay society charges based on above deficiency to the builder/builder run another utility service provider?
Techncially consumer case after 6 years of possession is time barred. Better recourse is to file criminal case against the builder for cheating. Also file consumer case to bring pressure. You can also approach the RRDA / RMC under Apartment Act.

Yes you can very well file a case before the consumer forum in your district where the flat is situated against the developer regarding the poor construction but first verify the specifications give in the agreement
