29-May-2023 (In Property Law)
My father is missing since 28th November, 2007. What is the process that needs to be followed so that the court / Municipal Corporation give me a death certificate which can be furnished or transfer of assets that were in his name.

u must be having police complaint of missing report of your father filed at that particular time in 2007 and notice to be sent to the collector in your area and after that you have tp move to the court to get such order

You will have two applications before the concerned Civil Court. First application you will declaration of his death & second for Heirship rights. Until & unless your first application has been decided, your second application won't be maintainable at all.

There are 2 ways, firstly you have to file a civil suit in court for getting declaration of death from court. Or the second thing is you can directly file for heirship certificate in court and get a heirship certificate declaring yourself and others as his legal heirs. But you have not mentioned in your query whether have you or any one from the family has filed missing complaint of your father?
