Damage to property due to refusal to rectify flat upstairs what to do

There has been extensive damage to my DDA flat due to faulty bathroom sewer and water lines of my upstairs neighbour. He is refusing to get the damage rectified. What should I write in my Police complaint that I wish to file?

You can file a suit for damages against the Defendant for the damages caused to your premises because of the casual or deliberate behaviour of your neighbors in a civil court ..
The said neighbors are liable to pay an amount to the extent of the damages caused.

You should file a complaint before the DDA as well as with the police. The grounds should be mischief, criminal intimidation, intentional insult to provoke breach of peace in police coupled with negligence, avoidance of responsibility and damage to the property made by government in DDA. For a suitable draft can consult with documents and proof of damages incurred.

It is more of a civil dispute. You must get an estimate for repair and file a civil suit for damages. A police complaint would be applicable only if you can point our to any specific violations under the IPC.

If the damages are not been rectified by him and not been paid then you can go ahead seeking damages from him along with injunction to restrain him form such activities in future .Therefore issue him a instant legal notice stating your grievances please contact for further details thanks.

You should serve a legal notice through a lawyer and then file suit for for mandatory injunction seeking direction to neighbour for repair and maintenance and also permanent injunction against him. With the permission of the court you can get the problem fixed and recover costs and damages from him. Police will not do needful as the dispute is of civil nature.
