Clarification on registration of property in partition dispute

10-Mar-2023 (In Property Law)
Hi. We have a land at a prime area, in my grand mothers name, grand ma had 2 sons,1st son staying at ground floor of the house, 2nd son on first floor, there was dispute among brothers regarding properly and case was filed at court, the judgment from the court is the land should be divided equally by both of them.......now being financially weak, they won't be able to construct newly....now queries are 1. Is it ok to register the property according to floor wise....means ground floor 1-st son, 1st floor 2nd son..... 2. Is it better to register half the land by both of them 3. It is it better to sell the property... Please advice

First you measure and partition the whole sital area into 2 equal parts, Next you allot one each floor between 2 sons along with one half share of land. describe one floor with one half land into one schedule and so make a partition deed between the two. Next get these registered. Selling is their option.

once the property was divided by the court the automatically both are have equal rights on the land. They can register the document. get a legal expert to draft registered document. they will put the condition of equal rights on property, not to disturb the other share holder, etc etc
