Change of Ownership of Flat in CHSL after father's death.

My father expired recently. He has a flat in CHS in his name. I wish to change the ownership of flat. I wish to transfer the flat in my mother's name and wish to add my name as a 2nd owner. How to proceed with the formalities?

you can file petition for legal hairship ( Succession ) certificate. on the basis of the certificate you can entered your mothers name. After sanctioning the mutation in PR Card automatically ownership of the flat will be transferred on the name of Mother. for further details contact me through LawRato.

Depends how many other legal heirs he has. You need to apply for Heirship Certificate before the concerned Civil Court. After that court will pass orders for publication of public notice and citation will be issued. Thereafter you will have to file your affidavits. Then your application will be allowed by the court. Orders can be communicated with society.

Well, you have to transfer the Share Certficates on your name and for doing so, you have to show the Death Certificate and Legal Heirship Certificate to the Society Members to transfer the Share Certificates of Property on the name of First Class Legal Heirs which is your Mother and You. If your Father had created a Will before dying, then accordingly the Flat in CHS will go to that person & as such, that person or someone on his behalf has to show the Death Certificate and Will to the Society's Management Committee.
