Challenge a high court decree being objector

A decree being passed against my house which i purchased in 11 Nov 2002 . I have registered GPA of the same. A case was filed against the previous owner on 26 Nov 2002 . 15 days after I have purchased half part of the land from him. I was not informed by the DH and JD till 2018. Suddenly one day belif of the court comes with police force and throw my items out of my house. After enquiry i got know about the Decree and the execution case that is pending in court. I appear as a objector in execution case. My question to this forum is, can I challange the decree passed by the HighCourt being an objector in execution case as I am the necessary party in the case and DH and JD hide this fact from the court?if yes , then what will be the process?

hello client as i can see andcread your query is really a challanging condition as you are saying JD and DHC hided the infotmation from you about the execution matter pendency. now yhe decree has been passes against you. yes the decrre which is been passes against you csn be challanged and been abjector and necessary party you can get chance to prove you saying . but it can be done in supreme court.

Sir first of all you have to file a stay application in execution proceedings alongwith your objections and secondly if stay is rejected then you have to challenge the same before division bench of Hon’ble high court seeking stay.

Hi if this is your case then you have to file a suit of recovery from the JD , you could have file your objections in the executive court but now it’s too late as the decree has been executed rest advice I can give you after discussing the case in details Thx
