Cancellation and execution of a new will

21-Sep-2023 (In Property Law)
I am Hindu. My father has executed a property will in 1990's before his death is 2012. In his will he has stated that after his death his wife shall be entitled to and shall have right of ownership & reside throughtout her life and also right to sell the property if she desires so. My question is that does she have the right to cancel my father's will now in 2018, If so can she make new changes as per her wishes and if this new will can be challenged.

Hi, your mother (Father's wife) can execute a Relinquishment Deed in the favor of any person she desires to. Yes, she may further execute a new will as well. For more information feel free to have a word with me. All the best.

Will executed by you late father cannot be cancelled by your mother. She is the beneficiary in the Will and can give her property to anyone as per wishes by executing her Will. You may consult us for legal services
