Can I claim share in property of my diseased father

sir i want to ask that my father was die . and in my family my brother and mother will not give me a rights in my father property . and i am married . can i get share in my father property .

Yes ofcourse u have full right to get ur share from urs father property. It does not matter either u are married or not but for u share u have to file a civil petition .

Yes you can definately claim your 1/3 share in property in case your father has not executed any valid will in favor of your mother or brother during his life time. Being one of the son you have got a legal right and file a case for the same.

Yes u can get the share being the natural heir. After the death of your father your mother, your brother and you are entitled to the property left by the deceased in equal shares. In case, there is a will then we can challenge the same in order get your share. A civil suit for declaration and permanent injunction has to be filed.

Hello , well I assume that you are a woman and wish to claim right in the property of your father who has died. dear Madam, you have a right in the property and your brother and mother can not sell or transfer the property to anyone , until you give a consent to it. So, you have a right in the property and you can file some civil case in the court wherein, you can seek relief that they may not sell the property and can not transfer the title of property. This way they shall have to settle with you and give your share out of the property.

Yes u can get share of father,s property. Whan any person died his all legal representative has a right of property in equal share. you have a right of his father's property as a legal hair..if no registered will in favor of mother or brother by the deceased father, u can easily get the his share of father's property..if they have not agree for this work..u can file a civil suit to get share of father's property...
