If the property becomes the name of your mother then your brother can not claim . If your property has been acquired by your father, then your brother and his wife can not claim on that property . If the property belonged to your grandfather and he had been given to your father, then your brother would be entitled to it.so don't worry .

Dear mam as you querry you can claim your right in the father property according to the law the property of the father is divided equally between son and daughter equally so you can easily claim this right

If the property earn by your parents only than she can not able to claim on such property. If your father make any will for your mothers than she has right to make the transfer the title. But there is not any such document than the legal process make you all the legal heirs (Mother+Brothers+Sister). One more process is that if your brother or you and your sister can make a no objection certificate or want to change the property title with only the name of your mother than mother would be the only beneficiary. This is not ancestral property so your brother's wife can not claim for her rights in that such property.
