Can brother claim in father's property which is leased out.

Mere father ki 2 shaadi hue thi, hum sab saath me rehte the, badi mammi pehle expire hue, then kuchh years baad papa b expire hog aye, dono mammiyo k bete h, papa ki 2 property h, dono pehle papa k naam se thi baad me 1 property badi mammi k bete k naam se ki gayi, and dusri property meri mammi k naam se registry ki gayi jo ki JDA se lease par h, ab tak sab sahi chal raha h, but kya futher me bade bhaiya claim kar sakte h is property par jo ki meri mammi k naam se h (JDA lease par), please guide asap.

Matter seems to be quite complicated, under which law the two marriages were performed, which law applies for succession. unless the whole case with facts is presented, no specific recommendation can be given. ask the client to contact me.

Do property thi jo ki dono patniyo ko barabar milni thi, par ek property badi Mammi ke bete ke naam par kar di gayi tatha dusri property dusri patni yani aapki mother ke naam par kar di gayi to ye aap ki ho jayegi, Koi yadi bade bhaiya karte hai to yahi ground aap rakh sakte hai.

Your father must have made family batvaranama in which he must had mentioned all details of property which he had given to his both wife's.if not then you can make a family batvaranama and get registered and get registered in your mother name
