22-Nov-2023 (In Property Law)
Property belonged to my grand father who had purchased it himself and built a house. Property was transferred in my fathers name by my grand fathers by will after his death. My father entered in an agreement with a builder to develop the plot and he got monetary compensation and a flat in the new 5 storey building. my father died this year and i was informed that the flat was transferred in my sisters name through a gift deed when he was alive.can i challenge this transfer to stake a claim in the said property.my mother is still alive.

Dear Sir

You can challenge that gift deed in civil court by filing civil suit of cancellation, declaration & partition as well as you may claim some amount that property in possession of sister.

yes,

you can challenge the gift deed but it will require court cases to cancel the gift deed as well as few other legal steps to bring the case in your favour.

you have already spent enough time to decide , so please decide fast and start taking legal steps as one year has already passed from the death of your father.

If your sister is having more share than you. You are free to challenge this gift deed in the court. That property is ancestral so you can have equal share in that property. And you can claim in this property.
