Builder not replying to notice

I bought a flat from builder. They are 4 partners. 2 have received the legal notice sent to them. The notice could not be sent to 2 other partners. Can I still file case against them or do they all need to receive the legal notice first? nnThey have not installed the lift yet as promised and also illegally cobstructed a fifth floor in the building. We are proceeding with civil case. Could you tell me how many years we have to file the case from date of registry? Is it within 2 years.

Hi
Sending a legal notice is not a mandatory step to sue the builder. You may file a civil suit (within 3 years) for the violation of / breach of the builder buyer agreement. The illegal construction may also be reported to the MCD. Feel free to get in touch to discuss further.

Each and every partner of the firm is not required to be issued notice. Since two partners have received notice, case can be filed.

you can file civil case within 3 years of transaction.

consider filing criminal case also.

We need to read the agreement which is executed between u n the builder or their company and go through the terms of installation of the lift. Subsequently we have to file the suit for specific performance in this regard accordingly! Thanks

We advise you to seek a detailed legal consultation from a lawyer and formulate a strategy. Yes you can file a suit for recovery or claim damages for poor workmanship. Time period is 3 years for seeking recovery . You may contact with better particulars

Yes you can file a civil suit for recovery of damages and also seek specific performance as well.
Also we need to file it before the expiry of three years otherwise it will be barred by limitation

You need to hire expert advocate in this regard and the said advocate needs to file suit for injunction & damages in this regard as soon as possible !
