Issue a legal notice to the builder to refund the entire amount with an interest..,After the notice if you failed to get prompt response from the builder that you can file an suit against him before the consumer forum under the defieciency in the Service and claim damages for mental agony and criminal breach of trust..,Second option is that you can file a case against him before the civil court by recovery of money by initiating summary proceedings.

Your case has been referred to em by Lawrato. You say you have cancelled your booking. Whether the owner/ builder has given a cheque to you, and / or a reciept ? Have you paid only booking amount or full or part payment ? You can file a consume case as it is without much court fee.

In your case you informed that you have purchased a plot. But i hope it is not the purchase it may be the agreement for sale. Any way, as you told that you had paid the amount and the registration is not done. You can approach the Civil Court by filing the case under the Specific Relief Act contending the violation of the terms of the Agreement and not paid the amount .

Or you can file a case for recovery on the ground of breach of the terms of the contract.

Dear Sir,
As per your query you can file a consumer case against builder after sending legal notice to the builder. or if you interested you can claim for registering the plot as per your agreement and also you can claim compensation for delay.
