Builder is not ready to do the registration

Hi, Almost all other flat owners have done their registration. However, builder is delaying my registration without any reason. I have followed up on calls, emails, messages and also by visiting their office. No positive response, as if they are if ignoring to help me register the flat. They are not ready to even reply in any form. Have asked them multiple times the reason for ignoring my registration, nothing comes back. What options do I have?

Hi, you need to send them notice first by yourself and even after that if they ignore you will need to send legal notice and start legal proceedings by filing the case in court of law. before filing suit it is very much important to know whether there is any agreement between you and building and if yes whether it is registered or not. secondly and very importantly are in possession of the flat?. kindly revert and call me for detailed advice and the next scope of action

Hello sir Good morning, You may better issue a legal notice for delaying the process of registration. Otherwise ask him properly at the time he should be ready for registration. If he does not respond to the issue notice then you file a case against him.

Firstly send a legal notice through lawyer if they file to respond you have option to file for specific performance of contract or if you want refund you can file case in consumer forum. please feel free to contact if you need further consultation

Hi. I hope you are doing well. If the builder is deliberately delaying your flat registration without any valid reason, it amounts to deficiency of service and unfair trade practice; you should first issue a formal legal notice demanding execution of the sale deed within a specified time, and if there is no response, you can file a complaint before the Real Estate Regulatory Authority (RERA) of your State for direction to complete registration and seek compensation for delay, or alternatively approach the Consumer Commission for deficiency of service, and in appropriate cases even file a suit for specific performance before the civil court; keeping copies of your agreement, payment receipts, and all communication will strengthen your case.
