Bayana amount Didn't Refund...........

I sell my property 2years ago at 12lakh and buyer give bayana of 2lakh. i sell the property because of my daughter marriage at the end he refuse to buy the property after 3 months. I gave him 2 more months but he didnt paid then i took loan for the marraige and said him when i sold my property i give back your money but now after 2 years of dead deal he is saying he is going to court i don't have money. In bayana receipt its clear written if buyer refuse to buy the property the bayana will not be payed buy the seller. And signed buy both the parties and 3 witness.
Does this sufficient to win the case.

Hello Sir, I have gone through your query. In these circumstances you have an option to sue the buyer for the rest of the money as per the contract. Also you can ask for the damages caused to you in a civil court of law.
If the buyer backs out of a contract then the seller can sue for specific performance of the same.
