AGREEMENT DATE VS RERA COMPLETION DATE

Hi Dears,
I booked an apartment in Navi Mumbai in 2021 and the possession date on the registered agreement was 31.12.2024
Whereas the rera completion date is showing 30.06.2025 (original) and 30.06.2026 (revised)
Difference - 1.5 years
Can I make complaint to rera authority for delay in possession as per agreement

You can very well file a complaint to the RERA authority for delay in handing over the possession. As per law you can see compensation for the damages which includes the amount spend by you for staying on rental basis and for also for mental harassment. Further if you do not intend to withdraw from the project you can clam interest from the promoter for delay in handing over the possession. The complaint needs to be filed online however you need to see assistance from an advocate.

As per the provisions of RERA Section 18, you are entitled to claim compensation in the form of interest on the amount of consideration of the flat that you have paid till date.
The interest amount will be calculated for actual period of delay, which was beyond your control. If you can provide more details, more specific opinion can be provided

Well, you can file a Complaint before the RERA either to withdraw from the Project by seeking refund of the amount invested by you along with Interest + Litigation Cost + Exemplary Compensation+ Mental Harrassment Compensation or you can continue with the Project, but, can pray to the RERA to order Builder to keep on giving you Interest until you receive Possession from the concerned Builder along with Expenses which you will be incurring in terms of Rent to reside somewhere else other than his Project in which you have invested to buy flat!
