A member has made on rs.10/ stamp paper an agreement (unregistered) with the builder to use open land. Using it for last 30 yrs. No member raised objection. The same member is also on committee of the society. Also using open passage and staircase for his business.Secretary is not so serious. How to take proper action

Hello! whether the said agreement is notarized? why no one took an objection for last 30 years? member can claim benefit of adverse possession. He can not use common areas for business purpose. Can you tell me case in detail?

If NOC is not taken by other members of society. Then in that case no such agreement can be valid. You and other members can file civil suit against the member and builder against such agreement for using the open land by builder

File a Case before the Co-Operative Court or before Registrar of Societies. What that Committee Body Member has done is illegal. Builder and that Member both have to suffer economic lossess if you put this matter in Court.
