Gift deed for Resident Indian donor and NRI donee

05-Mar-2024 (In NRI Law)
Hi, I am a NRI and my mom is an Indian resident. She wants to gift money to me which I intent to outward-remit. Bank requires me to furnish gift deed for the same. At present I am not in India. 1) Can the deed be prepared after the amount is transferred to my account if I get the stamp paper issued before the transfer date? 2) Can I (donee) sign the deed later on when I visit India after the donor has already signed it beforehand? 3) Can my PoA in India sign the gift deed on behalf of me?

1. yes, it is possible that the deed can be prepared after the amount is transferred, it depends upon the mutual understanding of both the parties also you have to get into an agreement stating that you will complete the deed process with so and so time period after the amount is transferred. 2. it has to be signed then and there before the concerned authority. 3. yes, you can write POA and thr person in power can handle and give presence on your behalf. It is advisable to write a special power of attorney rather to write the general one. For more detailed discussion on the same you can connect me.
