Income Tax Notice for income assessment for NRI

18-Mar-2024 (In NRI Law)
My relative is an NRI and have some fixed deposits in NRE account in India. Now IT dept sends him notice that the income from FDs in 2015-16, have escaped assessment. He has been filing the return as NRI and replied that the income is from NRE -FDs which are tax exempted, he has also submitted the tax certificates issued by the bank; however still IT dept.is asking him to file the return and saying that the income has escaped assessment. Please guide what remedy is available in this case??

An application before the appropriate Court MUST be moved citing irregularities and malice against your relative. Since tax matters revolve around time as a key factor in assessment as well as calculation of fine, it is imperative that you act quick and wise.

in this case the best remedy is to file a complete legal reply to the department with complete details. the IT department has not put any penalty so no need to worry on that and it is only for assessment that the documents need to be procured. otherwise there is no legal provision under which the department can send you the notice.
