What will be compensation for accidental death in motorcycle accident

My father died in a motorcycle accident in 1998. He was on his bike and was run over by a public bus. He was 32 years old. He ran his own business and made around 4-5 lakhs annually. At the time of accident, our family included his mother, father, his wife, and 2 children. With regards to the above information: - Is it too late to apply for compensation? - If not, how much can we expect? - What would be the approximate time frame if we start a case to completion? Thank you!

There is no limitation period file a motor accident claim case. under section 166 Sub-S. (3) omitted, ibid (w.e.f. 14-11-1994). Prior to its omission, sub-S.(3) read as
under :-
“(3) No application for such compensation shall be entertained unless it is made
within six months of the occurrence of the accident.
Time limit for completion Approximately 1 to 2 years .

I think, it is too late for filing Motor accident claim case. Though, there is no Limitation period for filing case exist now but, it is very tough to establish the case after 19 yrs. of alleged accident. However, you can try. If, your statement about his age and income is correct then you can claim more than 40 Lakh as compensation.
