What to do if my car is involved in a accident

My Car was hit by a Bolero Pickup Loader on 01 Jun 18, going in same direction during overtake. Police is telling there is no need of FIR, on primary report(which is not FIR) the case will be settled. please guide me. thanks in advance....

According to law they should lodged a F.I.R. against that Bolero pickup vehicle driver, if there is no F.I.R. then you will not have security of settlement and afterwards if you want to claim damages from insurance company F.I.R. is necessary.

This is my response to you: 1. It is my request you to file FIR immediately; 2. Do not listen to the police, under section 154 of CRPC, the police have to register an FIR; 3. If you do not file an FIR then someday the bolero pickup may file a case on you and claim compensation from you; 4. Therefore you should take the first step.

If it is a private car and has private car insurance policy then FIR and police report is not mandatory. But having a panchnama of damage to the car will definitely help alternatively a valuer or insurance companies surveyor will do the loss assessment.
