THIRD PARTY INSURANCE CLAIM FOR CAR ACCIDENT

Today my car was parked in the society and one pickup came and hit it. My car was damaged. As per my car insurance company's advice i need to claim 3rd party insurance and asked me to logged a complaint in the nearest police station. I have the FIR copy with me. Now my advisor is asking me to hire a lawyer and file a lawsuit for settlement. He also mentioned that the driver was not having a driving licence so his insurance company is not liable to pay any kind of compensation. Please advise what should I do. Thanks.

even though the driver is not having license the liability of insurance company cannot be completely waived off you need to approach court for the claim of the damages caused to your vehicle for further enquiry contact on the number
