Person hit my father with two wheeler, refusing to pay. What to do ?

My father was walking on the street when a scooterist hit him and he suffered body injuries and leg bone fractured. No insurance for the two wheeler and the person who hit him is refusing to pay. An FIR has been filed on the person for rash driving without horning. How can we claim compensation in this case?
I need to know what is in the FIR .because with out insurance how can he ride the bike. If is so we can file some criminal case also. We need to know whether it is a stolen bike/,his own bike. So let me know the details
