Penalty for accused and negotiation

I have met with accident,drunken boy who doesnt has driving licence hit me with duster car,while i was pillion riding in a a bike..i got my 3 bones fractured in my right leg,and a minor fracture in right hand.the one driving bike had minor injuries.my lawer suggesting to accuse someone with licence to claim insurance money of car.if accused is proved to be guilty,what is the punishment he will get.what are the ways to demand more money other than insurance...i lost my valuable 6 months life during which i would have earned 8 lakhs..and hospitalization cost me 5 lakhs
If the court finds out that you have played fraud on court to recover damages you will be in more trouble. I suggest you to file case without misrepresentation as you can still claim compensation from Owner and driver of the vehicle jointly.
