No fault of owner of the car in accident. How to proceed ?

If in case some other vehicle comes and hit my car which damages my car wherein there is not even a 1% fault of me. Then do I need to get a compensation from the other vehicle's driver ? What if he denies to give me the compensation and also denies to accept his fault?. How does the law decides whose fault it is if there is no witness or no cctv clip which proves that its a fault of the other vehicle driver?Does the investigation on damage of my car can be the evidence to prove whose fault it is?

Definitely , you must lodge a FIR and a written complaint with local police. Further you may also issue a legal notice for compensation and then sue him by initiating civil and criminal prosecution. Surely you will get the relief.

Only you should have done is recorded the incidence in your mobile or camera so that it could have helped you in producing evidence before the police station or in future in the Court. You should make a complete against the car owner in the police station where the accident has occured. If he denies to pay you can file a complaint against him before the Hon'ble Motor Accident Claim Tribunal. for more call on my number.
