Mandatory wearing of Helmet by pavilion riders

I am from Tamil nadu. Is it mandatory to wear helmet for pavilion rider(who is sitting at the back seat) who are women in 2 wheeler
As per motor vehicle act, both persons should wear helmets. but in Tamilnadu, it is not mandatory to wear the helmet for pavillion rider ( the person who is sitting at the back seat) . Whether the riders are women or men, it is immaterial before law..
