MACP case against me and my insurer for liability of an old man
19-Aug-2023 (In Motor Accident Law)
A MACP case is filed against me and my insurer for a liability of an old man who got dashed by my bike on a 6 lane highway as he was crossing the road on his cycle. His leg got fractured. However, it was not my fault as I did not break any rules. Instead he was the one who drove the cycle on the road while there was so much traffic. Now he has pleased for a no fault liability of Rs. 25000. Is this liability to be paid by me or my insurance company and do I need a lawyer for this case?
In most of the cases No fault liability would granted. As u r bike is insured u need not to worry. Yes u have to engage an advocate to defend ur case. Though it is not your fault but u have to establish that u have not breached any policy term or condition.
It depends on whoes liability it is. If you are fully insured your insurance company will be liable to pay. A case can be made out and your insurance company will be a third party to the case a/w you. The roads are open for all be it a diver, rider or a walker everyone has an access to it.
