License renew delayed by RTO office accident happened in between

An accident happened. My father was driving. The accident happened in 15 july. My father has a heavy vehicle driving license. One boy died in a accident. We applied for renew of license 28 may in RTO office, we paid the fees as well on 28th may. But we got the renewed license on 16 july. Will it be a strong case if we defend ourselves but the delay is from the RTO office.

Yes, we can have a strong case and defend ourself by stating this ground that there has been a delay on the part of RTO officer. One the case will start, we will take delay by RTO officer as a ground. The only condition is that the license should be in continuity, the day we apply for renewal and on the date we get our license renewed is the period of continuation.
In case if renewal is denied by RTO officer then, by what reasons. Any letter/notice given by RTO authority.

Required documents: application for renewal/form of renewal, notice/letter in case of denial.

Yes you should contest the case and prove this fact of your driving license on record. It will be considered as valid driving licence. But you must take care that you are represented in the court and your lawyer is able to prove this fact on record.
