IPC SEC 279,337 and 338 have been imposed on me for no fault of mine

I meticulously checked for any vehicles on the road, slowed down my car, and turned right with proper signaling. Despite taking all possible safety measures, a bike suddenly appeared out of nowhere with no headlights or warning, and crashed into the center of our car. The impact was so powerful that our car skidded towards the extreme right corner of the road, creating a false impression that I had intentionally done so. He got fractures and surgeries. Ipc sec 279,337 nd 338 have been imposed.

I understand your frustration , but it is a fact that our police / mvi 's charge 279 , 337 and 338 of IPC especially when the other party's bone is fractured , and if he died due to the impact of the accident 304 A IPC will be charged . what I want to know is whether any cctv camera is installed on the road . If it installed you could easily submit those footage to police and in their final report they will remove charges against you if they are convinced. Footages of dashcam recordings of near by vehicles during the time of accident is also fine. Usually no one accepts their fault and the other party may file complaint against you for getting claim from your motor vehicle insurance. In that case you have to approach Highcourt for quashing the FIR against you .
Usually 279 attracts small fine but 337, 338 of IPC attracts minor imprisonment. Need to contact a law practioner urgently to get documents related to your accident from police .
