Questions Answered by Advocate Sreejith T. V.
Q: Want a legal advice to the following
I had been working as a staff at petrol pump. There was a rush of customers and one of a customer argued with me as he had been waited for long time and he suddenly talk to me bad words and beated me and with a rush I also beated him back. After that he filed a case against me with attempt to murder. I was unaware of the seriousness of case as I was 19yr old that time. Adv who worked for left the case when it seems like he cannot take bail and it may lead to warrant.Dont know what to do.
Advocate Sreejith T. V. answered
In the middle of the crowd , without any motive , no one will try to murder another person . It is very difficult to prove this case by police / prosecution . Now I want to know what is the nature of his injury ? Have you filed a counter case ? do you have injury ? is there a cctv footage ? based on that only next course of action can be decided . You may even take right to private defense as an excuse .
Q: Pre Trial Steps In Case In Family Court Case
Hi, if a case is filed in family court, how many pre trial sessions will be there.. What are the procedures in pre trial steps
Advocate Sreejith T. V. answered
It depends on the type of family case . If your case is a mutual divorce , there will be no Trial a such and only pre Trial steps includes the counselling/mediation, affidavits and it it will be considered within a specific separation time . For other cases like one sided divorce petitions , custody of the child , maintenance etc - considerable time will be spend on correspondence / summons , Interlocutory applications for interim reliefs , handling of proceedings my Chief Ministerial Officer ( C M O ) etc.
Q: Quashing detiles, and how can mmi close this case very easily, ho much
I got bail from high court, the case now in high court, mean while i got summens from local court, and i have presented, the petitioner party is ready for settlement, so what is the progecure fo quash, and how can i close this case very easily
Advocate Sreejith T. V. answered
If the matters is settled between the parties , then the person who filed complaint against you must sign the affidavit stating that he has settled this case and has to file it before highcourt and you must file a petition to quash the fir / chargesheet . Meanwhile, you may get stay of your case in lower / local court from highcourt . Then the highcourt may ask the police to enquire whether the case is settled and after getting report from police and after verifying the affidavit the highcourt may quash your case . If the case against you is of very serious nature like murder, pocso offences etc it is very difficult to get quashed .
Q: IPC SEC 279,337 and 338 have been imposed on me for no fault of mine
I meticulously checked for any vehicles on the road, slowed down my car, and turned right with proper signaling. Despite taking all possible safety measures, a bike suddenly appeared out of nowhere with no headlights or warning, and crashed into the center of our car. The impact was so powerful that our car skidded towards the extreme right corner of the road, creating a false impression that I had intentionally done so. He got fractures and surgeries. Ipc sec 279,337 nd 338 have been imposed.
Advocate Sreejith T. V. answered
I understand your frustration , but it is a fact that our police / mvi 's charge 279 , 337 and 338 of IPC especially when the other party's bone is fractured , and if he died due to the impact of the accident 304 A IPC will be charged . what I want to know is whether any cctv camera is installed on the road . If it installed you could easily submit those footage to police and in their final report they will remove charges against you if they are convinced. Footages of dashcam recordings of near by vehicles during the time of accident is also fine. Usually no one accepts their fault and the other party may file complaint against you for getting claim from your motor vehicle insurance. In that case you have to approach Highcourt for quashing the FIR against you .Usually 279 attracts small fine but 337, 338 of IPC attracts minor imprisonment. Need to contact a law practioner urgently to get documents related to your accident from police .
