If a person got killed in an accident what would be legal penalty

I am a law student and my doubt is suppose a person killed other by mistake in an accident. What would be his penalty? Would he be having criminal record now for lifetime? Under which section the offence would fall?
If a person commits a crime by killing a person negligently and harshly then the accused person will be tried under section 304A IPC OR 304 IPC. Moreover the kins of deceased can file claim petition in Motor accident claim Tribunal for compensation against the owner of the vehicle involved in the accident and against the driver of the vehicle and if vehicles insured then against insurance company also
