Filing a case of accident when driver was drunk and without license

A 21-year-old person under the influence of alcohol hit my father with a two wheeler and caused serious head injury (brain bleed, contusion, parietal bone fracture and several other bruises/injuries all over the body). He does not possess a licence. Now my father who was previously independent in all his activities is dependent on someone for each and every activity and according to doctors, it may take several months even for the bleed to subside. The person who caused accident is not willing to pay anything as compensation and says whatever he can give is only after claiming from the insurance company. FIR is yet to be filed and it is 9 days since the accident. Now if I want to file a case against this person, how much can I claim as a compensation and how should I proceed.

quickly you have to lodge complaint against that boy mainly with the bike details like registration no and the place of accident. after that you have to file case in motor accident claim tribunal jurisdiction. only through that way you could claim compenstion. dont believe that person. very important things. collect all medical bills which has been spend for you father. each and every rupee will be collected through court as compensation. quickly contact the advocate and consult them. take care of your father.

you can file an mcop petition before the motor accident claims tribunal against the person who made accident and also the insurance company claiming compensation for injury caused, loss of income, mental agony etc. you can claim compensation as provided under the motor vehicles act. you have to lodge a complaint and register FIR. if the officials refuse to register FIR you can file a petition before the High Court for direction to the officials to register the case. approach a lawyer with all relevant papers for redress
