Family valid for compensation of brother's death in road accident?

My brother aged 28years has met with accident and died on the spot in Gurgoan. A rash driving water tanker hit him from behind.Police caught the driver of water tanker and kept him in jail.We got the information that the driver of water tanker don't have the proper licence.My brother's income was 10lacs per annum. Are we eligible for compensation, if yes can we claim from Bangalore as we are from Bangalore?

Yes your are liable for companesation ....you just have to prove one thing in this that your brother's income was 10 lac per annum and if he was driving something he was having a proper driving licence...
