Cought in an accident with a pedestrian with my scooty(uninsured).

My father who was driving a scooty met with an accident with a pedestrian (an old lady) who came running on the road in front of the vehicle. She sustained head injury and developed subarachnoid hemorrhage but never developed serous complication. Unfortunately our scooty was uninsured and they lodged an Fir under 279 338 they are demanding a heavy compensation, but my father had no fault in this accident, he was on right path of road and he never drive fast. My father himself admitted the old lady and also paid 14000 to the hospital so that the treatment to start early and also wited in hospital a whole day but still they lodged the complaint. Please give some advice what to do next... We never faced court before and it's scary to think about it....
