Compensation for 2 wheeler accident driver ran away post the accident

My brother in law age 40, was killed in hit and run case on 30 August . He was in two wheler and someone dash him from back .. he died after taking to hospital . The driver ran away after the incident. We had not renewed the 2 wheeler insurance policy also.. is there possiblity of filling a case under section 166 of Motor vehical act or any other whoch can help to get good compensation to his wife

Definitely you must file compensation claim before your motor accident tribunal and should also claim for no fault liability wherein as of right claimant is entitled for 40 thousand rupees. Also do inform police and register FIR against unknown , Di not delay. Delay is always fatal.
