hi in present case you have both option you may either under wc act file a claim petition to labour court or u/c 163 a m.v. act file a claim to mact court both forum is open you can opt any forum . whichever suits you.

it will be in labour court if driver should have a driving licences then it is easy to fight.if you have no licences than donn't worry we manage it. if you are rajasthani you should also claimed for 50000 rupees [state relief] in district collector with in one month.
