Can a person get promotion after he has been acquitted

My brother which is a government employee was driving a two wheeler motor cycle with a pillion rider and met an accident ,the rider survived the mishap but pillion rider unfortunately died police made a case under section 304 ,304A and 279 IPC against my brother on first hearing court dissolved the 304 sectionas no grounds but due to 304 ipc he got detained for more than 48 hours and got suspended. Suspension was revoked later but promotion was not granted now since 304 has been removed can he get his promotion now.
First and foremost you must one while talking to a doctor or a lawyer that anything shouldn't b briefly discussed over telephone or mail.
