Bail out a vehicle involved in an accident that was surrendered

20-Jun-2023 (In Motor Accident Law)
I got involved in an accident and a case has been filed against me. I have surrendered before the court and have obtained bail. After that i have now surrendered my vehicle in police station. My lawyer has asked to find out a person who has a vehicle with a value of Rs. 11 lacs (value of my vehicle as on date is Rs. 11 lacs). My lawyer has informed me that no other mode of surety (other than a vehicle of equivalent value) is accepted for giving a bail. I had suggested that i give arrange for a person having property of equivalent value. But lawyer is insisting that only vehicle papers are accepted for taking out a vehicle on bail, as surety. Please advice if this is true.

I doubt the statement of your lawyer. As Houses, land and property can be used if you have enough equity in them. You need to check with your lawyer again about the same. Vehicles, furniture and personal effects may be suitable in some cases. The white goods, furniture or appliances that you use every day are not suitable because the loss of these items could cause you hardship. Tools of work are not suitable for the same reason.
Cash may be suitable but it will have to be deposited with the court.
You must own the assets you want to use to become a surety. Title deeds, mortgage papers, rates notices or bank statements showing mortgage payments help to prove that you own houses or land. For other property, receipts or registration papers will help.

No sir, it is not at all necessary to furnish surety in the form of a vehicle only but it may be in other forms as the court is careful about the amount of surety and is not a bit careful about the mode of the surety and even the papers of property of equal amount would serve the purpose.
