Accident case filed while driving father bike any case be filed on him

On motor bike we (cousin was riding ) hit another bike from behind as he stopped , I had knee injury and cousin loss three teeth and other party we hit got two fracture in leg , now they fill complaint against us to give his medical compensation bills(our bike insurance is expired so does other party) , police today took my bike in custody , bike papers is on my dad , when case stand did my dad also (bike owner) also punishable ? How long they will take bike custody
