Who is liable to pay appartment maintenance cost

Hello my tenant gave notification that he was going to vacate this month Aug 18 2016.But he was not able to vacate. Then He vacated on Aug 25.He already paid this month maintance cost rs1200.A new tenant occupied same apartment this Aug 27 once they left. Now my old tenant asking to repay maintance cost rs 1200.my question is who is responsible to pay maintance old tenant or new one

What is duration of The maintenance cost? If your old tenant has stayed there during the maintenance period of one year then he is liable to pay and if he has paid advance for the coming period then the new tenant is liable to pay.
