Tenant threatening action for deductions made against damages

16-Nov-2023 (In Landlord/Tenant Law)

Tenant gave 1 mth. notice as against 2 mths, leaving flat damaged , fridge in not working condition. He is not agreeable to the deductions I made . Threatens legal action. I live in different city. If he sends notice or petition to the address of the leased flat, then I will not receive it . What will happen in that condition? He does not have my address of residence . He is asking for my address of residence. What should I do ? Can he or his lawyer send petition by e mail?

You are confused between a petition and a legal notice. In order to initiate legal proceedings against you, they can send you a copy of the legal notice via e-mail, and it has to be corresponded with other modes that require your residential address e.g, registered post, courier etc. They cannot send you only via e-mail. So, you might tell them your address if you wish to.
