Hello sir i had rented a house to a tenant the tenant is not moving away from my house after my father's death,I am continuously asking him to vacate my house due to refurbishment and restoration. For almost one and half year am asking him to vacate the house the tenant is saying I will vacate this December in 2014 and when I asked in 2015 he said again that I ll not vacate now I ll vacate this year end that year also passed now he again started the same thing currently he is not paying my rent and his advance amount has also bee

First of all you should ascertain the ownership of the property. If it was your father's property then upon his intestate death all the legal heirs shall be entitled to a share in the property therefore all the legal heirs are joint owners. Under this situation, one person should get an authorisation from all other heirs either by a letter or by a GPA deed to maintain and manage the property on behalf of all. Then you should issue a legal notice asking him to vacate the property owing to the reasons that you may have. If he is not responding or refusing to vacate, file an eviction suit on the same grounds.
