Tenant not paying rent can I take legal action against him?

My brother who is staying in USA has rented out partial flat. The tenant has not payed the rent for last 6 months despite several requests and every time allowing him grace period to give him an opportunity to clear the rent but he has failed. Can we take legal action against him ?
