Gate locked by owner leading to terrace is this a legal Act?

I (with family) am living in 2nd floor of a 3-storied building. The main problem is that the Owner of 3rd floor put a gate on the common stairs which is leading to 3rd floor just six steps from my floor. The door is always kept locked. As a result, we are unable to access the upper stairs & landing platform for getting sun light during winter season or see the sky anytime. My question is :- i) Is this legal to put a door on common stairs which is leading to 3rd floor. ii) If illegal, then what action could be taken to remove the gate. Kindly advice.

If the owner of the building sold the II floor with exclusive roof rights you have no right to go there except to maintain your water tanks and TC antenna (if installed there) to for inspection/maintainace of common amenities.
You will have to inquire from the builder who sold the III FLOOR
